Terms of Service.
This Agreement governs the relationship between CABLELINK and the Subscriber and shall take effect upon the activation of the service.
1. SERVICES COVERED
The COMPANY shall provide the Pay TV (Analog CATV, Digital CATV and IPTV) and/or Broadband Cable Internet: I-BLAZE (DOCSIS) or FIBERLINK (FTTH) service(s) to the SUBSCRIBER in accordance with this Service Agreement. Other related services may also be included subject to the terms and conditions of the COMPANY.
2. RESTRICTIONS ON CATV VIEWERSHIP
The cable line and television signal, the subject matter of this Agreement, shall be used exclusively for household or personal viewing and shall never be used for business purposes. The SUBSCRIBER shall hold the COMPANY free and harmless from any liability that may arise from violation of this provision. The SUBSCRIBER hereby undertakes to uphold the property rights and interests of the company and hereby binds himself/herself to refrain from taping, recording, duplicating or otherwise reproducing, in any manner and form whatsoever and for any purpose, the programs, trademarks/logos, copyrights and services received by and passed to him under and by reason of this Agreement. A breach of this provision shall result in the termination of this Agreement without prejudice to the COMPANY's rights under the law.
Subscriber shall indemnify and hold innocuous the COMPANY, its associates, accomplices, directors, workers, investors, specialists and delegates from and against all claims, reasons for activities, decisions, harms, costs and liabilities emerging from or regarding (a) the utilization of Service by Subscriber other than as allowed by this Agreement, and (b) the substance of material that Subscriber sends through utilization of the Service including but not limited to, claims for defamation, invasion of privacy, disparagement and/or alleged violation of trademark of copyright.
3. RESTRICTIONS ON THE USE OF THE INTERNET SERVICE
The COMPANY has no capability to censor nor monitor the content accessible through the world wide web and assumes no liability for any claims, actions, damages or any suit arising from the use of the content accessed through the COMPANY's service platforms. The SUBSCRIBER may at his/her option, install software or related programs that may safeguard the use of their equipment/computers or any other electronic device against these inappropriate and harmful contents.
4. INSTALLATION AND SERVICE MAINTENANCE
Only the COMPANY'S representative shall be authorized to install, transfer, maintain and inspect the services availed of by the SUBSCRIBER. The SUBSCRIBER may choose the service application plan he/she deems best to suit his/her needs and as previously indicated on the form submitted to the COMPANY and installed at the SUBSCRIBER's premises. The SUBSCRIBER shall be liable and responsible for safeguarding and preserving all materials and equipment of the COMPANY and shall likewise be liable for whatever damages caused to such properties except through the normal wear and tear of the foregoing equipment installed by the company.
5. RELOCATION
Assuming the Subscriber will transfer residence/location, he may apply for relocation and will be charged the relocation fee prevailing at the time of relocation to cover for expenses of dismantling equipment from his current residence and re-installing to the new residence. If relocation is not within service coverage, the Subscriber's subscription, if still within the lock-in period, is deemed pre-terminated and the Subscriber must pay the full pre-termination fee. Application for transfer/relocation will only be allowed if the new address is within the COMPANY's service coverage and only if the Subscriber has no outstanding balance in the relevant account as of the current billing month and the other accounts of said Subscriber are in good standing.
6. ADDITIONAL INSTALLATION CHARGES
In certain instances, the Subscriber shall pay for additional charges to cover materials and labor for non-standard installations, depending on the length of the cable wire and other factors.
7. SERVICES STANDARD INCLUSIONS
The CATV subscription is inclusive of: provision of up to One Hundred Twenty (120) feet of RG 6 Coaxial Cable and other ancillary materials necessary to comply with industry CATV installation standard; free use of Set Top Box (STB), MPEG-4 HD DVB-C Receiver for Digital CATV or IPTV Box for IP delivered subscription.
The I-BLAZE Internet subscription is inclusive of: free use of DOCSIS WI-FI Cable Modem; provision of up to One Hundred Twenty (120) feet of RG 6 Coaxial Cable, one (1) Digital Splitter and one (1) High Pass Filter per installed Cable Modem.
The FIBERLINK Internet subscription is inclusive of: free use of Optical Network Unit (ONU), provision of up to Two Hundred (200) meters of FTTH Drop wire, FTTH termination Box, FTTH Patch cable and other ancillary supplies.
Each Set-top box (STB), IPTV box, Cable Modem (CM) and/or Optical Network Unit (ONU) installed is treated separately and shall be billed accordingly based on the package availed of by the SUBSCRIBER.
The standard inclusions are subject to change without prior notice depending on implemented technical standards of the company.
8. STANDARD SUBSCRIPTION PERIOD
The COMPANY requires a minimum lock-in subscription period of Twelve (12) months for Basic CATV; Eighteen (18) months for Digital CATV and Twenty-four (24) months for I-BLAZE and FIBERLINK Internet and IPTV service subscription from the SUBSCRIBER. The period is computed from the date of the activation of the service.
A pre-termination fee in the amount of: (1) Two Thousand Five Hundred Pesos (Php2,500.00) for Basic Analog CATV; (2) Five Thousand Pesos (Php5,000.00) for Digital CATV, I-BLAZE AND FIBERLINK Internet, shall be imposed by the COMPANY in the event that the SUBSCRIBER fails to complete the minimum lock-in period either, when he/she pre-terminates/cancels his/her subscription or when he/she fails to settle his/her monthly subscription, and the account becomes overdue.
9. SUBSCRIPTION FEE AND OTHER CHARGES
The SUBSCRIBER agrees to pay the company the subscription fees and charges imposed including all applicable taxes. The services to be offered by the COMPANY shall conform to the specific plan chosen by the SUBSCRIBER on the service application form provided for by the COMPANY.
Initial cash out including but not limited to installation fee, service deposit, advance payment and other charges may be required in accordance with the selected service plan. The deposit may be applied to unpaid or outstanding obligations upon termination of service AFTER the minimum lock-in subscription period.
Free Cable Usage is limited to the standard material inclusion from tap-off or network access point (NAP) to the SUBSCRIBER's exterior wall for CATV and Internet services. In excess of which, appropriate cable usage charges shall apply and for the account of the SUBSCRIBER at the prevailing rate.
The COMPANY applies the ratio of two (2) extensions for every main TV connection and the subscriber may apply as many connections as he/she desires based on this ratio at the prevailing monthly rate.
The COMPANY charges a minimum installation fee for Customer Premise Equipment (CPE) such as Set Top Box (STB) for Digital CATV subscription, DOCSIS WI-FI Cable Modem, Optical Network Unit (ONU), IPTV box and other similar devices for Internet Services.
Fees will be charged for repairs done inside the house or establishment, including but not limited to cable connection transfer, extension, disconnection, reconnection, any work done on CPE, including replacement, repair and/or reconfiguration thereof. Fees to be charged shall be at the prevailing market rates as determined by the company.
